Terms of Use

These Terms of Use ("Terms") are an agreement between you and T3 - Truchan Tactical Training ("T3", "we", "us") for the T3 Training app on Android, iOS and the web (the "App") and the t3.training website. By creating an account or using the App, you agree to these Terms and to our Privacy Policy.

1. Health and safety: read this first

The App provides general fitness training information. It is not medical advice. Physical training, including firefighter and tactical fitness preparation, carries a risk of injury.

• Consult a physician before starting any training program, especially if you have a medical condition, injury, or are pregnant.
• Stop exercising and seek medical help if you feel pain, dizziness, shortness of breath or discomfort.
• You are responsible for training within your abilities, using proper technique and equipment, and training in a safe environment.
• You voluntarily assume the risks of participating in any training shown in the App, to the extent permitted by law.

Training programs and performance targets do not guarantee any result, including passing a fitness test, hiring process or competition.

2. Your account

• You must be at least 16 years old to use the App.
• Keep your login secure. You are responsible for activity on your account.
• Provide accurate information. Some features, such as load calculations, depend on it.
• You can delete your account at any time in the App under Account → Delete Account (see account deletion).

3. Memberships and subscriptions

The App offers a free tier (Alpha) and paid subscription tiers (Bravo and Delta). Features of each tier are described in the App.

Billing and renewal

• Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price, until you cancel.
• Purchases in the Android or iOS app are billed by Google Play or the Apple App Store and are subject to their terms. Web purchases are billed through our payment provider.
• Prices are shown in the App before you buy and may differ between the web and the app stores. Applicable taxes may be added.

Free trials

• Where a free trial is offered, you will be charged when the trial ends unless you cancel at least 24 hours before it ends. Trials are available once per person.

Cancelling

• Cancel any time: in Google Play → Subscriptions, in your Apple ID subscription settings, or for web subscriptions from Membership → Manage Subscription in the App.
• Cancel at least 24 hours before the end of the current period to avoid being charged for the next one. You keep access until the end of the period you paid for.
• Deleting your account does not cancel a Google Play or App Store subscription. Cancel it in the store first.

Refunds

• App store purchases: refunds are handled by Google or Apple under their refund policies.
• Web purchases: payments are non-refundable and partial periods are not refunded, except where required by law. Contact us if you believe you were charged in error.

Price changes

• We may change subscription prices. We will give you notice before a price increase applies to your subscription, and where required you will be asked to accept it.

4. Coaching (Delta tier)

• Delta includes personalized coaching from T3 coaches, delivered through the App. Response times and session availability are provided on a reasonable-efforts basis.
• Coaching is fitness guidance only and is not medical, physiotherapy or nutritional treatment.

5. Acceptable use

You agree not to:

• copy, resell or redistribute the App's programs or content;
• share your account or paid access with others;
• attempt to access other users' data, interfere with the App, or bypass access controls or payments;
• use the App to harass others or upload unlawful or offensive content.

We may suspend or close accounts that break these Terms.

6. Content and intellectual property

The App, its programs, text, graphics and software belong to T3 or its licensors. We grant you a personal, non-transferable licence to use the App for your own training while you have an account. Training data you enter remains yours. You allow us to store and process it to provide the App.

7. Availability and changes

We work to keep the App available and accurate but do not guarantee it will be uninterrupted or error-free. We may add, change or remove features. If we remove a feature that is central to a paid tier, we will let you know.

8. Limitation of liability

To the maximum extent permitted by law, the App is provided "as is", and T3 is not liable for indirect, incidental or consequential damages, or for injury arising from your training. Our total liability for any claim relating to the App is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection law that cannot be waived.

9. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, unless the consumer protection laws of your place of residence require otherwise.

10. Changes to these Terms

We may update these Terms. We will post the new version here and notify you in the App of significant changes. Continuing to use the App after changes take effect means you accept them.
